Our success relies on our careful, responsible handling of personal data derived from our relationships with clients, business partners, employees, applicants and suppliers. This is why we uphold the following principles when dealing with personal data:

2. Role of the DPC

In its additional role of DPC, TAG ensures that the DPC is consulted on all matters regarding the protection of personal data at an early stage, to an appropriate extent and with support from the data controller.

The DPC’s independence, professional qualification and expertise in the field of data protection law and practice are guaranteed.

3. Data protection – general information

TAG keeps all personal data in strict confidence as per applicable data protection laws, in particular, the FADP.

TAG processes the personal data of the contracting party for the purpose of concluding or implementing a contract (justification).

Our website can generally be used without providing personal data. If a data subject wishes to use any special services provided by our company through our website, this might require the processing of their personal data. Whenever the processing of personal data is necessary and there is no legal basis for such processing, we will request the data subject’s consent in a suitable format after providing adequate information.

Please note that data transmission over the Internet (e.g. when communication by e-mail) may involve security vulnerabilities despite all security measures we have taken. We cannot guarantee the complete protection of your data from third-party access.

As a natural person and the data subject, it is in your personal interest to protect the system(s) you use (PC, laptop, etc.) against unauthorised third-party access, secure them with a robust password and refrain from disclosing said password to others. Please install a commercially available antivirus software (“Internet Security”) and update it regularly.

4. Collecting general data and information

The TAG website collects an array of general data and information every time it is accessed by a data subject or an automated system. These general data and information are stored in the server log files.

The following data can be collected: (1) the browsers and versions used; (2) the operating system used by the accessing system; (3) the website from which the accessing system reaches our website (so-called “referrer”); (4) the sub-pages of our website visited by the accessing system; (5) the date, time and duration of access; (6) an Internet Protocol address (IP address); (7) the Internet service provider of the accessing system; and (8) further similar data and information collected in order to protect our information technology systems in the event of an attack.

TAG does not use such general data and information to draw any conclusions about the identity of the data subject. Rather, the information allows us to (1) deliver our website content correctly; (2) optimise our website content and the methods with which we advertise it; (3) ensure the permanent functionality of our information technology systems and the technology of our website; and (4) provide law enforcement authorities with all information required to facilitate prosecution in the event of a cyber attack. TAG evaluates such data and information, collected in an anonymised format, both for statistical purposes and with the aim of increasing data privacy and data security within our company so as to optimise the protection of all personal data processed by us. The anonymous data contained within the server log files are stored separately from any personal data provided by a data subject.

5. Definitions

TAG’s Data Privacy Statement is based on the definitions used by the legislator in the FADP.

We want our Data Privacy Statement to be easily readable and comprehensible by the general public and our clients, prospective clients and business partners. To ensure this comprehensibility, we have put together a glossary of the terms used within it. It is available under the following link.

6. Cookies

Some websites, including that of TAG, use cookies. Cookies do not damage your computer system, nor do they contain viruses. Cookies help us make our web pages more user-friendly, effective and secure. Cookies are small text files stored on your computer by your browser.

Most of the cookies we use are session cookies. They are deleted automatically after you leave our web pages. Other types of cookies remain stored on your device until you delete them. Such cookies allow us to recognise your browser when you visit our website again.

You can configure your browser settings to notify you whenever a cookie is being stored, only permit cookies on a case-by-case basis, prevent storage of cookies for specific purposes or altogether, or activate automatic cookie deletion whenever you close your browser. If you do decide to deactivate cookies altogether, this might limit some functions of this website.

7. Apps, QR code and similar applications

When you scan a QR code, the external service provider who creates our QR codes for us can store specific information from your mobile device (e.g. the name and IP address of your device). The service provider exclusively processes this information on our behalf and for the purpose of providing anonymised statistical analyses about the users who visit our website and the way in which they use our services.

8. Server log files

The provider of our website automatically collects and stores information in server log files, which your browser transmits to us automatically. They contain the following information:

Browser type and version
Operating system, referrer URL
Hostname of the accessing device
Time and date of server access

These data are never associated with a specific individual. They are not combined with any other data sources. We reserve the right to conduct a subsequent review of this data if we become aware of specific evidence indicating unlawful use.

9. Contacting us via the website

If you submit our contact form or send us an e-mail, we will store the information you enter into the form (including your contact data) in order to process your enquiry and potentially ask you follow-up questions. We will never disclose these data to any third parties without your explicit consent.

10. Newsletter subscription, data and withdrawal of consent

If you wish to subscribe to the newsletter offered through our website, we will need a valid e-mail address, which you will use to log into our website, and information allowing us to verify that you are the owner of the e-mail address provided and that you consent to receiving our newsletter (using a confirmation e-mail in the double opt-in method). No further data are collected. We only use this data to send you the requested information and do not disclose them to any third parties.

You can withdraw your consent to the storage of your data and e-mail address and the use of your e-mail address for sending you the newsletter at any time, for example, by clicking the corresponding link in the newsletter.

11. Newsletter tracking (tracking pixel)

The TAG newsletters contain tracking pixels. A tracking pixel is a miniature graphic that is embedded in an e-mail sent in the HTML format, facilitating the creation and analysis of a log file. It allows the provider to evaluate the success or failure of online marketing campaigns statistically. Using the embedded tracking pixel, TAG can see if and when a data subject opens an e-mail and which of the links contained in the e-mail they visit.

The personal data which is collected through tracking pixels embedded in newsletters in this way are stored and evaluated by the data controller or through the electronic portal of an external provider appointed by the data controller in order to optimise the newsletter distribution and tailor the content of future newsletters to the interests of the data subject even more accurately. These personal data are not disclosed to third parties, nor are they used for any purposes other than those stated above.

Consent

By accepting our data protection provisions, the recipient of our newsletter consents to this data processing method on the basis of the information provided above.

If the data subject withdraws their consent, the data controller will delete these personal data. If you cancel your newsletter subscription, TAG will automatically interpret this as a withdrawal of consent. TAG will take all steps required to implement the aforementioned measures on a case-by-case basis.

12. SSL encryption

For security reasons and in order to safeguard the transmission of confidential content, such as enquiries you send to us as the operator of the website, SSL encryption is used on this website. Your connection is encrypted when the address bar in your browser changes from “http://” to “https://” and displays a padlock symbol.

Once SSL encryption is active, the data you transmit to us can no longer be accessed by third parties.

13. Right of access

As a data subject, you have the right to find out, free of charge, whether any of your personal data are being processed. To request this information, please use this form.

You will be sent all information required to assert your rights in accordance with the FADP and ensure transparent data processing.

The retention period of the personal data or, if this information is unavailable, the criteria for determining this period

TAG does not process personal data on the basis of automated, individual decisions.

14. Restrictions of the right of access

TAG may refuse, restrict or postpone the release of information following an access request, especially when this is required by a formal law, i.e. for the protection of a trade secret, when this is required due to overriding third-party interests, or when the request for access is clearly unfounded, i.e. it was made for a purpose that violates data protection provisions or is obviously malicious in nature.

TAG will inform the data subject why it refuses, restricts or postpones the release or transmission of information.

As the data subject, you may request the correction of inaccurate person data unless:

a legal provision prohibits the amendment of said data;
the personal data are being processed for archiving purposes that are in the public interest.

The data subject may make a privacy protection claim as per the Swiss Civil Code (CC; Schweizerisches Zivilgesetzbuch – ZGB) to request that:

a specific way of data processing is prohibited;
a specific way of disclosing personal data to third parties is prohibited; that the personal data are deleted or destroyed.

15. Objection to advertising materials

TAG hereby objects to the use of its contact information, provided in compliance with the legal obligation to publish a legal notice, for the purpose of sending unsolicited advertising and information materials. TAG expressly reserves the right to take legal steps if it receives unsolicited advertising information, for example in the form of spam e-mails.

16. Data privacy in the context of job applications and the application process

The data controller collects and processes the personal data of applicants in order to implement the application process. Processing may take place electronically. In particular, this method is used when an applicant uses an electronic channel of transmission to send relevant application documents to the data controller, for example by attaching a PDF file to an e-mail or another file type to an application form provided on our website.

For our application process, TAG works with an internationally renowned system provider. We use this company’s online software application to support our hiring procedures. This software plays the role of data processor, processing personal data on our behalf. The system provider merely has the right to process your personal data in accordance with our instructions.

When you apply to a vacancy we have advertised, the present data protection provisions govern the processing of your personal data in addition to our other data protection provisions, which have been communicated to you separately or are available on our website.

When you use the application function of a job portal or a similar online service provider (“partner”) to apply for an open vacancy, please note that that partner can store your personal data and collect data about the progress of your application from us. The partner will always use your data in compliance with its own privacy policy. The partner’s data protection and security standards equal ours (“GDPR Compliance”).

When the data controller enters into an employment contract with an applicant, the transmitted data is stored by the TAG companies for the purpose of implementing the employment relationship, which is carried out in compliance with all legal regulations and while safeguarding the data against unauthorised access by employees and third parties.

If the data controller does not enter into an employment relationship with the applicant as the data subject, the data subject’s application documents will be deleted automatically and without further notice 12 months after the applicant has been notified of the rejection unless the data controller has further legitimate interests that justify retaining the data. Further legitimate interests in this context may be, for example, an obligation to provide evidence in legal proceedings under the Federal Act of 24 March 1995 on Gender Equality (GEA; Bundesgesetz vom 24. März 1995 über die Gleichstellung von Frau und Mann – GlG).

17. Registration function

The data entered during the registration process enable the user to use the service. Users may receive information related to offers or registrations by e-mail, for example changes to the scope of services or technical aspects. The collected information corresponds to the fields of the registration form. It includes, for example, the user’s name, postal address, e-mail address, IP address and its purpose.

18. Social media buttons

Any functions (plug-ins) on the TAG website that are provided by third parties or social media platforms allow the user to share content to the corresponding social networks. This website uses social media elements (e.g. Facebook, Twitter, LinkedIn). You can usually identify these social media elements by the corresponding logos. We use the Shariff solution to ensure data privacy when sharing content in social networks. Shariff prevents the social media elements integrated into this website from transmitting your personal data to the respective provider as soon as you access their page. A direct connection with the provider’s server is only established when you actively click the corresponding social media element (thus providing consent). At that point, the respective provider receives the information that you have visited this website with your IP address. If you are logged into your corresponding social media account (e.g. Facebook) at the time, the provider will be able to link your visit of this website to your account. TAG has no influence on this process. The purpose and extent of data collection and the further processing and utilisation of your personal data are governed by the data protection policies of the respective social networks. Users should refer to these policies to learn about their rights and any settings they can adjust to safeguard their data privacy.

19. Twitter

Our website can incorporate features of the Twitter service. These features are provided by Twitter Inc., 1355 Market Street, Suite 900, San Francisco, CA 94103, USA. By using Twitter and the “Retweet” function, the websites you visit are linked to your Twitter account and made known to other users. Data is also transmitted to Twitter in the process. We would like to point out that, as the website provider, we have no knowledge of the content of the data transmitted or how it is used by Twitter.

20. LinkedIn

Our website uses features of the LinkedIn network. They are provided by the LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA. Every time you access one of our pages that contains LinkedIn features, a connection to the LinkedIn servers is established. At that point, LinkedIn receives the information that you have visited this website with your IP address. If you click the LinkedIn “Recommend” button while you are logged into your LinkedIn account, LinkedIn will be able to link your visit to our site to you and your user account. We would like to point out that, as the website provider, we have no knowledge of the content of the data transmitted or how it is used by LinkedIn.

21. XING

Our website can use functions of the XING network. They are provided by XING AG, Dammtorstraße 29–32, 20354 Hamburg, Germany. Every time you access one of our pages that contains XING features, a connection to the XING servers is established. As far as we know, no personal data are stored during this process. In particular, XING does not store IP addresses nor evaluate user behaviour.

22. YouTube

Our website may use plug-ins of the website YouTube, which is owned by Google. Its pages are operated by YouTube LLC, 901 Cherry Ave, San Bruno, CA 94066, USA. Every time you access one of our pages that contains a YouTube plug-in, a connection to the YouTube servers is established.

At that point, the YouTube server receives information about which of our pages you have visited.

If you are logged into your YouTube account, you enable YouTube to link your browsing habits to your personal profile. To prevent this, log out of your YouTube account.

24. Matomo

With your consent, we use the open-source software Matomo (www.matomo.org) to analyse and statistically evaluate your use of our website. This process uses cookies. Any usage data generated in this process is transmitted to our server only and consolidated into pseudonymous user profiles. We utilise this data to analyse how our website is used. The collected data are never disclosed to third parties.

IP addresses are anonymised (IP masking) and cannot be linked to individual users. You can withdraw your consent at any time by deleting the cookies from your browser or changing your privacy settings.

25. Vimeo

Our website uses plug-ins of the Vimeo video portal. They are provided by Vimeo Inc., 555 West 18th Street, New York, New York 10011, USA. Every time you access one of our web pages that contains a Vimeo plug-in, a connection to the Vimeo servers is established. At that point, the Vimeo server receives information about which of our web pages you have visited. Vimeo also obtains your IP address. This is the case even if you are not logged into Vimeo or do not have a Vimeo account at all. The data collected by Vimeo are transmitted to the Vimeo server in the USA. If you are logged into your Vimeo account, you enable Vimeo to link your browsing habits to your personal profile. To prevent this, log out of your Vimeo account.

26. Integration of third-party services and content

Despite its best efforts, TAG cannot rule out that third-party content, such as YouTube videos, Google Maps, RSS feeds or graphics from other websites, may be incorporated into its web pages. When such content is integrated, this always means that the provider of the content (hereinafter referred to as “third-party providers”) has access to the user’s IP address.

Third-party providers cannot send their content to the user’s browser without accessing their IP address. Consequently, the IP address must be transmitted for the content to be displayed. We make every effort only to use contents whose respective third-party providers use the user’s IP address for no other purpose than delivering their content. However, we cannot influence whether the third-party providers store the IP address for other purposes, for example statistics. If we are aware of any other uses, we will inform our users about this.

27. Objection to advertising e-mails

TAG hereby objects to the use of its contact information, provided in compliance with the legal obligation to publish a legal notice, for the purpose of sending unsolicited advertising and information materials. TAG and the other providers of these web pages expressly reserve the right to take legal steps if it receives unsolicited advertising information, for example in the form of spam e-mails.

28. Applicable law and place of jurisdiction

The website of TAG, a company based in Switzerland, is governed exclusively by Swiss (data protection) law unless other mandatory laws, particularly the EU General Data Protection Regulation (GDPR), apply to the data subject.

Any disputes between you, as a visitor and user of the TAG website, and TAG arising from the operation or use of these web pages fall within the exclusive jurisdiction of the court at the place where TAG is based, unless another mandatory place of jurisdiction applies to the data subject.

29. Changes to the Data Privacy Statement

TAG reserves the right to amend the present Data Privacy Statement as needed. Whenever changes are made to the Data Privacy Statement, it may take up to 30 business days for TAG’s new data privacy practices or any connected processes to be implemented. Please review this website regularly to learn of any changes that may have occurred. We will send you a notification (text message) when changes are made.

30. Scope and application of the Data Privacy Statement

This Data Privacy Statement applies to all TAG companies, i.e. all dependent Group entities, affiliated enterprises and their employees. In this context, “dependent” means that TAG possesses the authority either directly or indirectly to require the aforementioned companies to adopt this Data Privacy Statement and all resulting obligations due to its majority ownership of voting rights, majority in the corporate management or an established contractual agreement. The Data Privacy Statement governs all instances in which personal data is processed. In countries where the data of legal entities are protected in the same way as personal data, the present Data Privacy Statement equally applies to the data of legal entities or partnerships. Anonymised data, for example data used for statistical analyses or research purposes, are not subject to this Data Privacy Statement. The individual companies governed by this Data Privacy Statement do not have the right to establish provisions that deviate from the level of protection afforded here.

31. Accepting the Data Privacy Statement

The client/user/visitor accepts the content of the latest version of the present Data Privacy Statement in full. If any objections are raised, the Data Privacy Statement overrides the General Terms and Conditions (GTC) of TAG.

TAG assumes no liability for the accuracy and completeness of the information provided here.

Liability claims concerning material or immaterial damages arising from the use or non-use of the information presented here or the use of inaccurate or incomplete information are excluded.

All content published by TAG in a digital or electronic format is subject to change without notice. TAG expressly reserves the right to change, supplement, delete or temporarily or permanently suspend some or all of the content provided on its web pages without further notice.

33. Liability for links

Any references and links to third-party websites are outside of TAG’s responsibility. TAG does not accept any liability for third-party websites, i.e. websites that are not operated by a company belonging to TAG. Users access and use such websites at their own risk.
